Terms of Service

TopoScout reports are compiled from public data sources and are provided for preliminary and informational purposes only. They are not a substitute for a field survey, a stamped engineering report, or independent verification. Do not rely on a TopoScout report as the sole basis for any design, construction, flight, or regulatory decision.

01Agreement

These Terms of Service ("Terms") govern your access to and use of TopoScout (the "Service"), operated by TopoScout ("we," "us," or "our"). By purchasing a report or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

02The Service

TopoScout compiles publicly available geospatial and geotechnical data — including elevation, topography, FEMA flood zones, airspace classifications, temporary flight restrictions (TFRs), parcel information, and benchmark data — into a formatted site report and optional DXF drawing for a location you specify. The value we provide is the automated gathering, assembly, and presentation of this public data.

We do not perform field surveys, soil borings, subsurface testing, or on-site inspection of any kind. No professional engineering or land-surveying judgment is applied to your specific project through the Service.

03Data Sources, Accuracy & No Warranty

Report content is derived from third-party and government data sources (for example USGS, FEMA, FAA, NOAA/NGS, and county records). These sources may be incomplete, out of date, or inaccurate, and are updated on their own schedules outside our control.

The Service and all report content are provided "AS IS" and "AS AVAILABLE," without warranty of any kind, express or implied, including any warranty of accuracy, completeness, currency, merchantability, or fitness for a particular purpose.

You are solely responsible for independently verifying any information in a report before relying on it. In particular:

04No Professional Advice

A TopoScout report is not engineering, surveying, legal, environmental, or financial advice, and does not create a professional-client relationship. Reports are not stamped or sealed by a licensed professional. For decisions requiring professional judgment, engage a licensed engineer, land surveyor, or other qualified professional.

05Payment & Delivery

Reports are priced per order (currently $7 per report, with an optional DXF add-on at $42). Payment is processed by our third-party payment processor. We authorize your payment method when you place an order and capture payment only upon successful delivery of your report. Prices may change at any time; the price shown at checkout applies to your order.

06Refunds

If a report fails to generate, no payment is captured and the authorization on your card is released. You are only charged for reports we actually deliver.

If a delivered report is not what you needed, you may request a full refund within seven (7) days of delivery, no questions asked, using the refund link on your download page. Refunds are issued to your original payment method and typically appear within 5–10 business days depending on your bank.

When a refund is issued, access to the files for that order is closed. Self-serve refunds are limited to one per customer. If you need assistance beyond that, or if the refund window has passed and something is wrong with your report, email info@toposcout.com and we will work with you directly.

07Acceptable Use

You agree to use the Service only for lawful purposes and only for supported locations within the United States. You may not resell, redistribute, or represent report content as your own professional work product, or use the Service to violate any law or third-party right.

08Intellectual Property

The Service, its software, formatting, and presentation are owned by us and protected by applicable law. Underlying public data remains subject to its original source terms. Upon full payment, you receive a non-exclusive license to use the delivered report for your own internal and project purposes.

09Limitation of Liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from or related to your use of, or inability to use, the Service or any report. Our total aggregate liability for any claim arising from the Service or a report shall not exceed the amount you paid for that specific report.

10Indemnification

You agree to indemnify and hold harmless TopoScout and its owner from any claim, loss, or expense arising out of your use of a report or your violation of these Terms.

11Changes

We may update these Terms at any time. Changes are effective when posted, with the "Last updated" date revised above. Continued use after changes are posted constitutes acceptance.

12Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute shall be resolved in the state or federal courts located in California.
